TERMS AND CONDITIONS CONTRACT
1. A minimum deposit of 35% is required at the time of sale. Another 35% minimum is due when you are notified your furniture is in our warehouse. The balance must be paid with cashiers check, certified check or a bank money order to the carrier at the time of delivery. The balance could also be paid in advance, prior to delivery, by check, credit card, cashiers check, certified check or bank money order.
2. If we do not receive your scheduled percents within 15 days, after being notified that your furniture is in our stock, your deposit will be forfeited and your furniture will be put in our stock for resale.
3. It is impossible to control expanding and contracting of the wood caused by many different humidity conditions throughout the country. Because of the substantial discount we have given you, we are unable to service drawer and door adjustments, touch-up or leveling of the piece.
4. All furniture sold by this contract is sold with manufacturer's warranty only. In case of dissatisfaction, Thomasville Custom Connection, Inc. will report the problem to the manufacturer and Thomasville Custom Connection, Inc. will do as instructed by the manufacturer in resolving the problem. In the case of manufacturer's request to inspect or to return defective furniture, it is the customer's responsibility to return the furniture to Thomasville Custom Connection, Inc.'s warehouse.
5. If customer chooses to pick up his furniture at Thomasville Custom Connection, Inc.'s warehouse, all furniture needs to inspected prior to loading on customer's truck. Thomasville Custom Connection, Inc. will not be responsible for freight damages. Also, furniture picked up in North Carolina will incur North Carolina sales tax.
6. Thomasville Custom Connection, Inc. is not responsible for delays in delivery due to the fault of the delivering carrier or manufacturing delays. Deliveries shall be subject to, and contingent upon strikes, labor difficulties, riot, war, fire, delay, or delaying of common carriers, failure or curtailment of the Seller's usual sources of supply, governmental decrees or orders, or without limiting the foregoing any other delays beyond the Seller's reasonable control, and the Seller shall not be liable for any loss or damage arising therefore. The Seller shall have the additional right, in the event of the happening of any of the above contingencies, at his option, to cancel this Contract or any part thereof, without any resulting liability. Any delivery not in dispute shall be paid for regardless of other controversies relating to other delivered or undelivered merchandise. Delivery dates and times of goods purchased and sold under this Contract are subject to change without notice, and Thomasville Custom Connection, Inc. DOES NOT guarantee a date of delivery of the goods sold hereunder, and delay in delivery shall not void this Contract.
7. Responsibility for transit damage rests upon the delivering carrier. PLEASE inspect each piece before the driver leaves. WE WOULD RECOMMEND that anything received with obvious damage be refused by you before the driver leaves. Only refuse the item that is damaged, not the entire shipment. If freight damage is discovered after the carrier leaves, the customer is considered liable for repairs as well as the pickup and re-delivery fee. Thomasville Custom Connection, Inc. nor the delivery company will be liable after the delivery company leaves your home.
8. Thomasville Custom Connection, Inc. will not be responsible for furniture ordered or delivered which does not fit into your home or areas of anticipated use.
9. This Order contains the Entire Agreement between the parties and cannot be changed or terminated orally.
10. Due to ICC regulation, delivery trucks are prohibited from carrying empty boxes/trash. Our drivers will break down the furniture boxes as much as possible and leave them at your home in the location that you request.
